1. Article 2 (General Provisions)

• These rules set out how the prize draws will be conducted. The organiser of the prize draw is KOZJANSKI PARK, Podsreda 45, Podsreda, 3257 Podsreda, and the operator of the prize draw is KOZJANSKI PARK, Podsreda 45, Podsreda, 3257 Podsreda.

The rules of the prize draw are publicly available on www.castlepodsreda.com. These terms and conditions set out the rights, obligations and conditions of participation in the prize draw.

2. Section 2 (Place and Duration of the Prize Draw)

The prize draw will only take place on Facebook in Slovenia, during a certain period, which will be announced next to the prize draw on the Rooms & Apartments – Podsreda Castle Facebook page.

3. Article 4 (Conditions of Participation)

The prize draw is open to citizens of the Republic of Slovenia, residents of the Republic of Slovenia, aged 18 years and over. If the prizewinner is under 18 years of age, he/she must be represented by a person over 18 years of age who has the right to represent the minor by law and/or by virtue of a power of attorney.

Employees of KOZJANSKI PARK, Podsreda 45, Podsreda, 3257 Podsreda, or their immediate family members (including cohabiting partners), are not eligible to participate in the prize draw. Anyone else who applies must not have any support from the above. Any such participation shall be deemed invalid.

Purchase is not a prerequisite to enter the prize draw.

By applying in the manner specified in 4. Article 5, the entrant shall be deemed to have read and accepted the rules of the Sweepstakes.

The prize draw organiser and the prize draw provider are not liable for any lost data. The prize draw will end on the closing date specified in the prize draw. The results of the draws are final and there is no right of appeal.

4. Article 4 (Method of participation)

To enter the prize draw, visitors to the Rooms & Apartments – Podsreda Castle Facebook page must like the post, click on the active button and submit their email address, or as indicated in the individual prize draw, as a condition of entry.  All those who meet the eligibility requirements will be entered into a prize draw. Participation is not conditional on the purchase of products, as the prize draw takes place exclusively on Facebook.

The prize draw organiser and the prize draw provider have the discretion to disqualify entrants who violate the rules of the prize draw in any way and to withdraw them from the prize draw (insulting, repeated commenting – e.g. multiple data entry.

All conditions that are met in time will be entered into the draw. Failure to provide the required information on time (see Article 5) will result in forfeiture of the prize.

There is no limit to the number of entries in the different prize draws, so an individual may enter more than once, but only once per prize draw, and each individual may only be drawn once and may only receive one of the prizes in each prize draw.

5. Article 4 (Prize Draw and Prize)

The prize draws will be open to all entrants who meet the conditions set out in 4. Article.

The prize draw will be determined at the time of each prize draw.

The draw will take place at the headquarters of the prize draw organiser or provider. The draw will be carried out using a computer programme and will be monitored and duly documented. The draw will not be open to the public.

Entrants will also be validated (according to the terms and conditions) before the draw itself. If the person drawn is not valid (breach of the conditions set out in Article 4), the prize draw will be repeated until the person drawn (the answer) meets the requirements of the prize draw.

A record shall be kept of each draw by the person in charge of the prize draw, including: the date, time and place of the draw, the persons present, the conduct of the draw, and the winners. The minutes shall be signed, made in a single copy and kept by the prize draw organiser or operator.

The results of the draws are final and cannot be appealed.

Winners will be announced on the Facebook page on the day of the draw and notified via their email addresses. Winners will be asked to provide their personal details (name and surname, address) within 7 working days. The personal data requested must be sent in reply to the email received.

Any participation costs (internet access, etc.) will be borne by the prize draw participants.

Prizes will be awarded by the Organiser subject to the conditions set out in these Rules.

The prizes to be awarded by the Organiser are announced at the time of each prize draw and are known in advance.

Payment of all taxes on prizes is the responsibility of the organiser. Winners are obliged to provide their tax number before receiving their prize, in accordance with the Income Tax Act, if they are asked to do so by the organiser or the contractor.

No income tax is payable if the prize is worth less than €42.

For prizes exceeding a total value of EUR 42, winners are required to provide the prize draw organiser with their tax number and tax office. If the winner fails to provide the required information within the time limit, he/she will forfeit his/her right to the prize.

For winners, the value of the prize above €42 is included in the annual income tax base. Any prize won in excess of €42 is taxed at a rate of 25% of the value of the prize, plus a withholding tax coefficient, in accordance with the Income Tax Act (ZDoh-2). The calculation and advance payment of income tax is done by the organiser. If the amount of the calculated advance payment is less than EUR 20, no advance income tax is withheld and paid. Withholding tax is deducted at the same time as other income in accordance with the applicable rules. Any other tax liabilities will be borne by the winners.

6. Article 4 (Prize Collection)

The prize is not transferable to a third party. The prize cannot be exchanged for cash or any other prize, goods or services.

The list of winners will be announced on the day of the draw on the Room & Apartments Podsreda Castle Facebook page.

The prize will be offered to the winner or the person authorised by him/her at the Podsreda Castle, Podsreda 103,3257 Podsreda, on the agreed validity date of the prize draw, as it is a tourist service that does not have a physical form.

Upon acceptance of the prize, all obligations of the Promoter towards the winner will cease.

7. Article 4 (Publication of the winners)

The list of winners will be published on the day of the draw on the Room & Apartments Podsreda Castle Facebook page. All winners expressly authorise the publication of their first and last name on the Facebook page of Room & Apartmens Podsreda Castle, for which they will not claim any payment or compensation from the organiser.

8. Article 5 (protection of personal data)

The prize draw organiser and the prize draw provider undertake to use, store and protect the personal data obtained in accordance with the Personal Data Protection Act and the GDPR, and to use it solely for the purpose for which it was obtained.

By participating in the Promotional Activity, the participant confirms that he/she agrees to the rules of participation and allows his/her data to be used for:

• the winners are announced on the Room & Apartments Podsreda Castle Facebook page
• to be informed about future promotional activities and to collect your prizes.

9. Article 4 (additional information and complaints)

The Organiser, the Contractor or any other person involved in the prize draw shall not be liable for any damages arising out of the acceptance or use of a prize or arising out of prizes, which are expressly agreed to by the Participants. The Organiser shall also not be liable for any damages suffered by an entrant as a result of logistical difficulties, technical problems or other defects.

In the event of circumstances beyond the Organiser’s control (force majeure), the Organiser may cancel the prize draw by mutual agreement. The organiser must inform the participants via the Room & Apartments Podsreda Castle Facebook page. In such a case, the organiser shall not be liable for any damages suffered by the participants.

The Organiser reserves the right to change the Rules if technical, commercial or public reasons so require. The organiser will keep participants informed of any changes and updates to the prize draw on the Room & Apartments Podsreda Castle Facebook page.

The Promoter shall decide on all issues relating to the prize draw or the prize draw. the application of these rules is final and applies to all participants.

Any errors in the work and the conduct of the prize draw will be dealt with by the jury in a timely manner and in accordance with good business practice. In the event of a serious breach of the Rules, the Committee may void part or all of the prize draw and re-run the prize draw with appropriate corrections.

The terms and conditions of the prize draw shall be interpreted in accordance with Slovenian law.

Any disputes arising in connection with the prize draw will be settled amicably between the participants and the organiser, but if this is not possible, the competent court in Ljubljana will have jurisdiction to settle any disputes.
